CRIMINAL DEFENSE

At Mwangi Kiai LLP, we have a qualified team of Advocates with experience in Criminal Defense.   After the commission of the crime, investigation and arrest is done by the police officers. The police investigating a certain crime in Kenya is called Investigation Officer (I.O). 

If arrest is made today, the arrested person’s rights are protected by Article 49 of the Constitution. They include;

  • Right to be informed of the reason for the arrest
  • Right to remain silent
  • Right to communicate to an advocate
  • Right to be brought before court before end of 24 hours
  • Not to be forced to admit to the crime.

In Kenya, the burden of proving the crime is always carried by the prosecution. If any person is accused of committing a crime, it is the work of the prosecution to prove that that person committed the crime and that the person had the intention to commit the crime. If the prosecution fails in proving one of those two elements, then the person who is being accused of such a crime will be released by the court.
