In law, conveyancing is the transfer of a legal title of property from one person to another, or the granting of an encumbrance such as a mortgage or a lien. The term conveyancing may also be used in the context of the movement of bulk commodities or other products such as water, sewerage, electricity, or gas.

A typical conveyancing transaction contains two major landmarks: the exchange of contracts and completion. Conveyancing occurs in three stages: before contract, before completion and after completion. A system of conveyancing is usually designed to ensure that the buyer secures title to the land together with all the rights that run with the land, and is notified of any restrictions in advance of purchase. In the process of conveyancing, the law requires that certain taxes be paid during and after the purchase. They include; stamp duty, capital gain tax, land rates and land rents.

Land search

Before embarking on the conveyancing journey, we help our client by conducting three most important land searches.

  1. Official Search- this is conducted at the land registry to confirm the current owner of the land and whether the land has any encumbrances (charged to a financial institution).
  2. Physical Search- the last thing you want is to buy a land where there is a claim by a stranger for adverse possession, or where the land is a forest reserve, or the property has cases in court or the property is part of river reserves. To avoid that, we ensure that we visit the place where the property is situated and advise our clients on the condition of the said property.
  3. National Land Commission Search- the commission keeps on updating the list of titles that have been cancelled and the reason for cancellation. We ensure that our client’s properties are not mentioned in the said report and also not part of the Ndung’u report.
