Common Questions
A straightforward transfer typically takes 2-3 months from signed agreement to new title issuance. This includes due diligence (1-2 weeks), document preparation (1 week), stamp duty payment and assessment (2-4 weeks), and registration at the Land Registry (4-6 weeks).
Stamp duty is a government tax on property transfers. In urban areas (municipalities), it's 4% of the property value. In rural areas, it's 2%. This is paid to KRA before the transfer can be registered at the Land Registry.
Foreigners can acquire leasehold property in Kenya (up to 99 years) but cannot own freehold land. However, foreigners can own freehold property through a Kenyan company. We can advise on the best structure for your situation.
