View All FAQsUnder the Marriage Act, grounds for divorce include adultery, cruelty, desertion for at least 3 years, and irretrievable breakdown of marriage. For irretrievable breakdown, you must typically show you've lived apart for at least 2 years with consent, or 3 years without consent. We can assess your situation and advise on the best approach.
Kenyan courts prioritize the child's best interests. Factors considered include the child's age, emotional attachment to each parent, stability of each parent's home, the child's wishes (if old enough), and each parent's ability to provide care. Courts generally favor arrangements that maintain the child's relationship with both parents.
The Matrimonial Property Act provides for division based on each spouse's contribution. Contributions include monetary (income, investments) and non-monetary (homemaking, childcare, support of spouse's career). There's no automatic 50/50 split—division depends on proven contributions and may include the matrimonial home, investments, and other assets acquired during marriage.
When someone dies intestate (without a will), the Law of Succession Act dictates distribution. The surviving spouse receives personal effects and a life interest in the home. Children share the remainder equally. If there's no spouse, children inherit everything. If there are no children, it passes to parents, then siblings, then extended family. We can help obtain Letters of Administration and distribute the estate properly.
Uncontested divorces where both parties agree can be completed in 3-6 months. Contested divorces involving property disputes, custody battles, or maintenance disagreements can take 1-3 years depending on complexity.
